1.1. These General Terms and Conditions govern the relations between “SMILE DENTAL SERVICES” LLC (hereinafter “SMILE DENTAL” or “the Clinic”) and the persons who use the medical-dental services provided by the Clinic (hereinafter “Patients”).
1.2. “SMILE DENTAL SERVICES – Outpatient Clinic for Primary Medical Care – Individual Practice for Primary Care – Dental” LLC is a company registered in the Commercial Register and the Register of Non-Profit Legal Entities at the Registry Agency, UIC 202293778, with registered office and address: Sofia, Sredets District, 23 San Stefano St., fl. 1.
1.3. These General Terms and Conditions apply to the provision of medical-dental services in the field of dental medicine by the Clinic to Patients, and also apply to contracts concluded between a patient and the Clinic in written or oral form for the provision of medical-dental services.
1.4. For the purpose of providing medical-dental services by the Clinic, each Patient must provide informed consent, approve a treatment plan, and review and accept these General Terms and Conditions. By signing the Informed Consent, the Patient also declares agreement with these General Terms and Conditions.
1.5. Acceptance of these General Terms and Conditions is a prerequisite for the provision of medical-dental services by the Clinic in favor of a Patient.
1.6. A copy of these General Terms and Conditions is provided to the Patient together with the Informed Consent, and is also displayed in a prominent place at reception and in the common area of the Clinic. It is also provided upon request at reception.
1.7. In case of changes to the General Terms and Conditions, the Clinic shall notify the Patient in due time, who shall have the opportunity, within 3 days from the notification or familiarization with the General Terms and Conditions, to object to the changes made. If no written objection to the changes is received within this period, the changes shall be binding on the Patient and shall apply in his/her relations with the Clinic.
2.1. The Clinic provides medical-dental services including, without limitation:
• Examinations and consultations;
• Treatment of caries and gum diseases;
• Orthodontic services;
• Placement of dental implants;
• Teeth whitening and other aesthetic procedures.
2.2. The services are provided in accordance with applicable medical standards, Bulgarian legislation and professional ethics.
2.3. The Clinic reserves the right to change the scope of the services offered at any time.
2.4. The Clinic operates in certain fields of dental medicine. The Clinic does not provide emergency dental care and works only on the basis of pre-booked scheduled treatment.
2.5. At the first visit to the Clinic, the Patient fills in a medical questionnaire and undergoes the necessary diagnostic tests, X-rays, etc. At the discretion of a dental practitioner from the Clinic, additional examinations by doctors from other medical specialties may be required. After the initial consultation of the Patient, an individual treatment plan is prepared. The Clinic reserves the right to refuse treatment to persons who have not undergone the required consultations with the relevant specialist, have refused the tests necessary for diagnosis and treatment, or have not provided the documents necessary to assess their state of health.
2.6. The Patient must become familiar with the proposed treatment plan and, where necessary, with the information provided in the form of Informed Consent, covering:
• his/her state of health and diagnosis;
• reasonable alternatives to the proposed treatment;
• the proposed specific procedure and treatment plan;
• the possibility of not undergoing treatment and the potential consequences and risks of that choice;
• his/her obligations and the potential risks and consequences in case they are not fulfilled;
• the usual expected outcomes of the treatment;
• the risks associated with the treatment and possible complications that may occur during and after/as a result of it;
• the pain, discomfort and limitations associated with the treatment;
• the possibility to refuse and/or discontinue the treatment, as well as the risks and adverse health consequences associated therewith;
• the risk during the recovery period;
• the possible need for support during the recovery period, as well as the possibility that additional subsequent treatment may be required;
• the cost of the chosen treatment.
Treatment begins and the respective medical-dental services are provided only upon the Patient’s review, acceptance, completion and signing of the Informed Consent. Treatment begins as specified in the treatment plan after the Patient books an appointment in accordance with these General Terms and Conditions. In cases where the respective medical-dental services do not require the provision of informed consent, the proposed treatment shall be deemed accepted upon booking an appointment and appearing at the Clinic by the Patient.
2.7. The assessment of the necessity for certain activities to be included in the treatment plan, the nature, character, duration and scope of the treatment and procedures is made by a dental practitioner from the Clinic, taking into account the Patient’s individual needs and capabilities.
2.8. The Clinic reserves the right to refuse the performance of certain treatment, procedures or interventions included in the treatment plan in case the Patient does not provide full and adequate cooperation in the processes of diagnosis and treatment.
2.9. The Clinic reserves the right to make deviations and/or changes from the initial treatment plan and shall inform the Patient thereof in due time.
2.10. The Clinic coordinates the treatment plan, the upcoming procedures, manipulations, interventions and the accompanying medical-dental activities with the schedules of the Clinic’s dental practitioners and the Patient’s availability, provided this would not directly harm his/her health.
3.1. Appointments for consultation, examination or use of medical-dental services can be made by phone or email at the contact details announced for correspondence or at the Clinic’s reception.
3.2. The Patient must confirm the booked appointment during the Clinic’s working hours on the day before the visit, and if he/she does not do so, the Clinic reserves the right to cancel it automatically. In cases where the day for confirmation is a non-working day, the confirmation shall be made on the last working day prior to the visit.
3.3. If necessary, the Patient may reschedule or cancel an appointment no later than the end of the working day preceding the day of the scheduled visit.
3.4. If the Patient has confirmed the appointment and does not attend the Clinic, the Clinic reserves the right to charge the Patient 50% of the estimated cost of the consultation, examination or procedure planned for that day.
3.5. If the Patient is late for the scheduled and booked appointment, it may be rescheduled or refused by the Clinic due to the impossibility of carrying out the respective procedure in accordance with the Clinic’s schedule.
3.6. If the Patient has confirmed two scheduled visits and has not appeared to use the respective medical-dental service, the Clinic reserves the right to refuse subsequent treatments, regardless of the existence of an approved treatment plan.
4.1. Examinations, procedures and/or interventions, as well as other medical-dental services, may be performed by different dental practitioners working at the Clinic, depending on their specializations, experience and availability.
4.2. The duration of medical-dental services, examinations, procedures and/or interventions may vary both between different procedures and between different patients.
4.3. The presence of third parties during work in the dental treatment rooms is undesirable and could lead to adverse outcomes and health risks for the Patient. The Clinic reserves the right to refuse the presence of third parties during work in the dental treatment rooms.
4.4. Different dental practitioners or medical specialists may participate at different stages of the treatment, each being responsible within the scope of what he/she has performed. The Clinic is responsible for the work of the dental practitioners, medical specialists and staff in it.
4.5. The Clinic is not liable in case of a claim by a Patient who has interrupted visits and/or treatment and/or has visited other dental practitioners without the knowledge and consent of the Clinic’s dental practitioner, as well as in cases of non-compliance with the treatment plan or the instructions of the dental practitioner or medical specialist.
5.1. The prices for the provision of medical-dental services are determined according to the Clinic’s current price list, which can be obtained at the Clinic’s reception upon request or of which the Patient is informed by the respective dental practitioner or medical specialist. The Clinic’s base prices are in euros (EUR).
5.2. Payment for medical-dental services is made at the Clinic’s reception or by bank transfer.
5.3. The Patient owes payment according to the prices determined in the treatment plan after each visit. For some medical-dental services, advance payment may be required. In such case, payment of the amount due is a prerequisite for using the respective medical-dental service.
5.4. The Clinic does not offer installment payments and does not accept alternative payment methods other than those specified.
5.5. If an accounting document — invoice — is required, the Patient must inform the Clinic in advance, but no later than 5 days from the date of payment.
5.6. The Clinic does not work with financing by the National Health Insurance Fund and/or health insurance funds and insurance companies.
5.7. If the Patient wishes to use insurance or supplementary health insurance, he/she must organize the document flow and communication according to his/her needs. The Clinic does not undertake commitments in this respect.
6.1. The Clinic undertakes to provide sufficient staff, technical and material support for the usual needs of the work of carrying out the medical-dental activities for which it is registered.
6.2. The dental practitioners comply with all regulatory requirements of Bulgarian legislation related to their activity.
6.3. The Clinic is released from liability for damages (material/non-material) if the Patient has not fulfilled any of his/her obligations under these terms.
6.4. The Patient undertakes to strictly follow all instructions, prescriptions and recommendations of the Clinic’s dental practitioners and medical specialists, to take medicines in the manner indicated by the dental practitioners and medical staff at the Clinic, and to attend the obligatory periodic check-ups.
6.5. The Patient undertakes to avoid any risky behavior or habits that could harm his/her health or could frustrate/hinder the successful outcome of the treatment/procedures.
6.6. The Patient undertakes not to take medications that have not been prescribed by a doctor and are not consistent with his/her condition and the treatment/procedures being carried out.
6.7. The Patient undertakes to plan in advance and ensure the possibility to participate in and comply with the treatment/procedural plan for the duration of the treatment.
6.8. The Patient undertakes to strictly observe the schedule under the treatment plan, as well as the schedule for check-up visits.
6.9. The Patient undertakes to follow the instructions and prescriptions in the manner in which they were given by the doctor.
6.10. The Patient undertakes to correctly inform the doctor of newly occurring conditions/changes/sensations in the course of the treatment, in view of the doctor’s need to assess his/her condition.
6.11. In case of non-compliance with the treatment plan, failure to attend medical, incl. check-up, examinations or tests, failure to obtain additional consultations, failure to provide information, as well as where the doctor’s recommendations/instructions/prescriptions are not followed, the Clinic, respectively the dental practitioner or medical specialist, shall not be liable for damages — deterioration of the condition, harm to health, etc., regardless of whether they occur as a result of the treatment or not.
6.12. The Patient undertakes to set aside time for check-ups and, unless his/her treatment/procedural plan provides otherwise, to attend at least once a year for a check-up in order to assess his/her condition and provide up-to-date instructions for maintaining good oral health.
6.13. The Patient undertakes to make a long-term commitment to organizing and carrying out the necessary hygiene and to take care of his/her overall general health.
6.14. The Patient undertakes to fully complete a questionnaire/medical history form regarding his/her state of health and to correctly inform the attending doctor about his/her medical history. The Patient must provide the doctor with full and accurate information about his/her state of health, including allergies, medications taken, past illnesses, harmful habits and other facts that he/she considers may be relevant to the treatment being carried out. Failure to fulfill this obligation may lead to incomplete, inadequate treatment and/or a harmful result for the Patient, and may also impair his/her quality of life and/or put him/her at risk.
6.15. The Clinic shall not be liable to the Patient in the event of a discrepancy with his/her expectations, incl. from an aesthetic point of view, provided that the treatment and restoration have been successfully carried out.
6.16. Patients have the right to be informed about the upcoming activities related to their treatment and to seek a second opinion before proceeding with treatment.
6.17. The Patient has the right to refuse treatment at any stage, assuming the health risks associated with such refusal. In the event of a refusal of the ongoing treatment, the Patient shall pay for the medical-dental services performed up to the moment of refusal, as well as the cost of the materials and medications used. On the basis of Art. 90, para. 4 of the Health Act, the Clinic may decide to carry out life-saving treatment despite the refusal.
6.18. The Clinic may refuse to provide medical-dental services in case of violation of internal rules, non-compliance with these General Terms and Conditions or a threat to the health and safety of the staff.
6.19. The Clinic may refuse treatment in case of medical contraindications or lack of the necessary consent from the Patient, or in case of non-compliance with any of the obligations under these General Terms and Conditions.
7.1. The Clinic is not liable for complications arising from non-compliance with the Dental Practitioner’s recommendations by the Patient.
7.2. In case of medical error caused intentionally or due to gross negligence, the Clinic shall be liable in accordance with the applicable legislation.
7.3. The Patient is responsible for providing false, inaccurate or incomplete information regarding his/her state of health.
7.4. The Clinic is not liable for adverse reactions if the Patient has not notified of allergies or other contraindications, as well as due to refusal of treatment, non-compliance with the treatment plan, failure to attend medical, incl. check-up, examinations or tests, failure to obtain additional consultations, failure to provide information, as well as where the doctor’s recommendations/instructions/prescriptions are not followed; the Clinic, respectively the dental practitioner or medical specialist.
7.5. The Clinic is not liable in case of a claim by a Patient who has interrupted visits and/or treatment and/or has visited other dental practitioners without the knowledge and consent of the Clinic’s dental practitioner, as well as in cases of non-compliance with the treatment plan or the instructions of the dental practitioner or medical specialist.
7.6. The Clinic is not liable for pecuniary and/or non-pecuniary damages and/or lost profits if the Patient has not fulfilled any of his/her obligations under these General Terms and Conditions.
7.7. The Parties shall not be liable for full or partial non-performance of contractual obligations if it is due to force majeure circumstances.
7.8. The Party that is unable to perform its obligations due to a force majeure circumstance must notify the other Party in writing within 10 days of its occurrence, as well as of the expected period of effect and termination of the force majeure circumstance.
8.1. The Clinic processes Patients’ personal data in accordance with the Personal Data Protection Act and the General Data Protection Regulation (GDPR) in accordance with the Clinic’s Privacy Policy published at https://implants.bg/.
8.2. Personal data will not be provided to third parties without the Patient’s explicit consent, except in the cases provided for in the Privacy Policy and the applicable legislation.
8.3. All activities of the Clinic are carried out under conditions of confidentiality, and the parties undertake to maintain confidentiality regarding all circumstances that have become known to them during or in connection with the activities carried out and the medical-dental services provided.
8.4. Dental practitioners are obliged to preserve medical confidentiality and not to share health information unless otherwise provided by a legal act.
9.1. These General Terms and Conditions may be updated by the Clinic periodically, with changes taking effect from the date of their update.
9.2. All disputes arising in connection with these terms shall be resolved by mutual agreement, and if impossible — through court proceedings under the legislation of the Republic of Bulgaria.

2. Dental practitioner: A person who holds an educational qualification degree — Doctor of Dental Medicine — and performs activities at the Clinic under item 1.
3. Medical-dental services: A set of diagnostic and therapeutic activities carried out at the Clinic under item 1.
4. Patient: Any person who has sought and/or to whom medical-dental services are provided at the Clinic under item 1.
5. Treatment plan: An integral part of these terms specifying the medical-dental services offered and/or performed on Patients, following informed consent.
6. Informed Consent: A process of information exchange within the meaning of § 1, item 15 of the Supplementary Provisions to the Health Act, with requisites included under Art. 88 et seq. of the Health Act, by which the patient is informed about his/her dental condition, treatment options — the nature of the proposed treatment, possible risks and complications, contraindications, alternative methods of treatment, as well as recommendations and conditions that the patient undertakes to fulfill before and/or after the respective treatment.
7. Spheres of activity: Dental medicine:
7.1. Examinations:
• Initial consultative examination for a specific problem raised by the patient — carried out at the patient’s first visit in compliance with these General Terms and Conditions.
• Comprehensive initial consultative examination — carried out at the patient’s first visit in compliance with these General Terms and Conditions.
• Secondary consultative examination — carried out under the prepared treatment plan in compliance with these General Terms and Conditions.
• Preventive examination(s) — carried out for patients of the Clinic whose treatment plan has been completed and whose condition has been monitored following the conclusion of a dental practitioner who has determined that the check-up examinations following treatment should be performed for preventive, not treatment-follow-up, purposes.
• Check-up examination — carried out after completion of the treatment plan in order to monitor the patient’s condition and take necessary measures if needed before the patient is directed again for preventive examinations.
The number and scope of check-up examinations are determined at the discretion of the Clinic’s dental practitioners, and the patient is always informed thereof.
7.2. Oral hygiene and cleaning of tooth surfaces:
• Scaling (removal of tartar) with ultrasound and/or manually.
• Polishing with air-polishing (sodium bicarbonate) and/or paste in cases of plaque, discolorations and deposits.
• Oral hygiene — training and monitoring.
7.3. Preparation for tooth surface whitening systems
• Home whitening systems
• In-office whitening systems
• Combined whitening systems
7.4. Dental services in the field of periodontology.
• Periodontal probing/measurement of periodontal pockets formed.
• Deep scaling (curettage) — per tooth, per dental quadrant, per jaw or full-mouth.
• Periodontal surgery
7.5. Restoration and filling of tooth surfaces — obturation
• Covering enamel wear.
• Cervical caries.
• Closing a contact point.
• Caries or replacement of a defective filling.
• Caries or replacement of a defective filling near the nerve.
• Build-up of a dental surface.
• Aesthetic build-up of an anterior tooth.
7.6. Endodontic treatment.
• Primary endodontic treatment — of a vital tooth.
• Secondary endodontic treatment — of a previously devitalized tooth.
• Removal of a post and/or broken instrument.
• Build-up of an endodontically treated tooth (with or without a post)
7.7. Dental prosthetics.
• Fabrication of temporary restorations — crowns — chairside or laboratory-made.
• Single crowns
• Bridges
• Partial and/or complete dentures
• Dental implants with delayed or immediate loading
7.8. Aesthetic dental prosthetics:
• Aesthetic crowns
• Veneers on anterior teeth
7.9. Bite correction.
• Consultations for taking impressions allowing bite analysis.
• Treatment for occlusal calibration.
• Fabrication of a splint for daytime and/or nighttime wear to stabilize the bite and/or protect the teeth from fracture and wear.
7.10. Oral surgery.
• Extraction/removal of a tooth, tooth root or implant.
• Extraction/removal of a wisdom tooth
• Surgical removal of inflamed tissue around the tooth root.
• Surgical crown lengthening.
• Soft-tissue graft around a tooth or implant.
• Bone graft
• Sinus lift
• Dental implants
7.11. Orthodontic treatment:
• Orthodontic analysis.
• Bite raising (in children)
• Orthodontic treatment with a removable appliance
• Orthodontic treatment with a fixed appliance
• Orthodontic treatment with braces
• Combined orthodontic treatment
7.12. Dental services for pediatric patients
• Examinations — initial, orthodontic and preventive
• Removal of dental calculus, polishing with sodium bicarbonate and/or paste, oral hygiene (training and monitoring)
• Restorations (fillings) — on primary and/or permanent teeth
• Endodontic treatment — on primary and/or permanent teeth
• Extraction of a primary tooth
• Orthodontic treatment
8. Force majeure circumstances: Objective impediments — circumstances (events) entirely dependent on and due to unpredictable or non-forecastable events or factors, independent of the will or actions of one or more persons and therefore not preventable, such as: any natural disasters, whether typical for a particular region or not; global or local (of national significance) accidents, incl. fires; epidemics; civil unrest; strikes; riots and any kind of disorder; terrorist or military actions and other similar events, as a result of which the normal public rhythm of life is disturbed and, accordingly, the possibility of unimpeded performance of commitments undertaken between two or more parties under concluded contracts is impeded.
9. Consultation: Includes all discussions and recommendations concerning the patient’s dental condition.
10. Examination: Includes taking medical history, visual inspection, ordering tests where necessary and making a diagnosis.
11. Procedure: Any action by the dental practitioner toward the patient.
12. Intervention: A surgical procedure that involves breaching the integrity of tissues and/or organs.
13. Dental treatment: a set of procedures, operations and interventions for improving the condition of teeth, gums and the oral cavity.
